LETTER FROM OUR CEO - SEPTEMBER 2023

Businesses in South Africa are waiting expectantly for the promulgation of the government’s significant amendments to the Employment Equity Act (EEA), which were expected to go live on 1 September 2023.


Previous communications from the Department of Employment and Labour (DEL) had indicated changes would kick in from the start of the month – however, more recent communications alluded to the start date being pushed back. I am seeing more push back from the business world against these proposed changes. We have penned an article on employment Equity below to try and make sense of what is or is not required by the fire pool kid!


The High Court in Gqeberha granted H&I Construction an interdict stopping Sanral from proceeding with the adjudication and award of two specific tenders in accordance with the amended tender scoring system as advertised by Sanral on 19 May 2023 in an addendum to its tender document.


Judge Nyameko Gqamana said in the High Court in Gqeberha accepted that Sanral is empowered in terms of the Preferential Procurement Policy Framework Act (PPPFA) to determine its own preferential policies and has a discretion to make its own policy choices regarding the specific goals it wishes to pursue.


The judge said the transformation agenda by Sanral to ensure broader black participation is commendable, a step in the right direction, and long overdue – but the policy has to be fair, lawful, and rational.

If you have a registered business, you need to declare the beneficial Ownership of that business to the CIPC.


The CIPC imposes compliance penalties for non-compliance. Providing inaccurate information knowingly is an offense under the Companies Act and may result in penalties and criminal charges. Water availability is following the same path as our electricity supply – the significant difference is we can survive without electricity (like many have been) but we cannot live without water! No matter how man campaigns and policies the Government implements it is not going to help. Water leaks, broken infrastructure, and a true will to repair and then replace fools is the only way it will be repaired and restored! You will never fill a bucked with three holes no matter of many buckets of KFC you eat discussing it!
