New EE Requirements

The Employment Equity Act (EEA) was recently revised, and there are a number of new requirements that employers must comply with.

These include:

  • Increasing the representation of Black people, women, and people with disabilities in senior management positions.

  • Implementing affirmative action measures for Black people, women, and people with disabilities.

  • Conducting regular EE audits.

  • Reporting on EE progress to the Department of Labour.

B-BBEE Update

The Broad-Based Black Economic Empowerment (B-BBEE) scorecard has also been revised, and there are a number of changes that employers must make to their scorecards.

Increasing the weight of the ownership element of the scorecard.

Managing the "new" elements to the scorecard, such as supplier development and enterprise development.

Changing the way that points are awarded for different elements of the scorecard.

HR Policies and Procedures as per the Revised EE Act

The revised EEA also makes changes to the requirements for HR policies and procedures. These changes include:

  • Employers must have a written EE policy that sets out their commitment to EE.

  • The policy must be communicated to all employees.

  • The policy must be implemented and monitored.

  • Employers must take steps to address any barriers to EE.
